These General Terms of Use constitute a legally binding agreement between you and SureCape (Pty) Ltd ("SureCape", "we", "us" or "our"). They govern your access to and use of the SureCape website, web application and all transportation services made available through our platform. By accessing the Platform, creating an account, requesting a quotation, making a booking or using our Services, you agree to be bound by these Terms.
1. Contractual Relationship
These Terms govern the contractual relationship between you and SureCape. SureCape operates a technology enabled managed mobility platform through which Customers arrange pre booked transportation services. Unless otherwise agreed in writing, your contract for Services is with SureCape, even where a Service is delivered by an approved transport partner on our behalf.
2. The Services
SureCape provides managed ground transportation services including airport transfers, chauffeur services, corporate transportation, event transportation, private transfers, day tours and long distance transportation. Services remain subject to availability, operational requirements, safety considerations and applicable law. We may update, modify or discontinue aspects of the Services from time to time.
3. Access and Use of the Platform
You may access the Platform only for lawful purposes. You are responsible for maintaining accurate account information and safeguarding your login credentials. You may not misuse the Platform, interfere with its operation, reverse engineer its software, scrape its content, introduce malicious code or attempt unauthorised access to our systems. We may suspend or terminate access where necessary to protect the Platform or enforce these Terms.
4. Bookings and Transportation Services
Bookings are confirmed only when SureCape issues a booking confirmation. You are responsible for providing complete and accurate booking information. SureCape may reasonably substitute vehicles, drivers or approved transport partners to ensure the safe and efficient delivery of the Services. Drivers may refuse or discontinue a Service where safety, security or legal compliance reasonably requires them to do so.
5. Payment
Applicable charges will be communicated before confirmation. Payment may be required before the Service commences unless otherwise agreed. Additional charges may apply where a confirmed booking is materially changed. Refunds, cancellations and no shows are governed by the applicable cancellation policy and South African law.
6. Your Responsibilities
You and any passengers travelling under your booking must comply with these Terms, applicable laws and all reasonable safety instructions. You remain responsible for passenger conduct, damage caused through negligent or intentional acts and ensuring that prohibited or unlawful items are not transported.
7. Privacy
SureCape processes personal information to operate the Platform, administer bookings, communicate with Customers and comply with legal obligations. Our handling of personal information is governed by our Privacy Policy and applicable South African privacy legislation, including POPIA.
8. Intellectual Property
All intellectual property rights in the Platform, Website, software, branding, content and underlying technology remain the exclusive property of SureCape or its licensors. You receive only a limited licence to use the Platform for its intended purpose.
9. Disclaimers and Limitation of Liability
The Services are provided with reasonable care and skill but remain subject to operational constraints, traffic, weather and third party interruptions. To the fullest extent permitted by law, SureCape excludes liability for indirect or consequential losses, including missed flights, meetings, accommodation or business opportunities, except where liability cannot lawfully be excluded.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. The parties will first seek to resolve disputes in good faith. Subject to applicable law, disputes shall fall within the jurisdiction of the competent courts of Cape Town, South Africa.
11. General
SureCape may amend these Terms by publishing an updated version on its Website. Continued use of the Platform constitutes acceptance of the revised Terms. If any provision is unenforceable, the remaining provisions remain effective. These Terms, together with the Privacy Policy and applicable Booking Confirmation, constitute the entire agreement regarding the Services.
